Terms & Conditions – Pet Boarding, Daycare & Ancillary Services<\/strong><\/h1>\n<\/div>\nThe Barkery and Brews \u2013 Bangalore, Karnataka<\/strong>\n
\n

1. Introduction<\/strong><\/h2>\n<\/div>\nThese Terms & Conditions (\u201cAgreement\u201d) govern all services provided by\u00a0The Barkery and Brews<\/em>\u00a0(\u201cService Provider\u201d), including but not limited to pet boarding, daycare, grooming, hydrotherapy, transportation, and related pet care services.\n\nBy availing any service, the pet owner (\u201cOwner\u201d) agrees to be legally bound by this Agreement.\n
\n

2. Compliance with Applicable Laws<\/strong><\/h2>\n<\/div>\n2.1 Services are operated in accordance with applicable Indian laws, including:\n
    \n \t
  • Prevention of Cruelty to Animals Act, 1960<\/li>\n \t
  • Applicable Animal Boarding Establishment guidelines<\/li>\n \t
  • BBMP (Bangalore civic authority) regulations<\/li>\n<\/ul>\n2.2 The Owner confirms compliance with all applicable pet ownership regulations, including vaccination and licensing requirements.\n
    \n

    3. Eligibility & Admission Requirements<\/strong><\/h2>\n<\/div>\n3.1 Pets must be healthy, non-contagious, and fit for boarding or daycare.\n3.2 Mandatory vaccinations (with valid proof):\n
      \n \t
    • Rabies (ARV)<\/li>\n \t
    • DHPPiL<\/li>\n \t
    • Kennel Cough (mandatory for boarding; must be administered at least 5\u20136 days prior)<\/li>\n<\/ul>\n3.3 Pets must be dewormed and under active tick\/flea prevention.\n3.4 A mandatory temperament\/orientation assessment is required prior to onboarding.\n3.5 The Service Provider reserves the right to refuse admission based on health, age, or behavior.\n
      \n

      4. Restricted Admissions<\/strong><\/h2>\n<\/div>\n4.1 Geriatric pets may be declined due to the active nature of the facility (exceptions may be made case-by-case).\n4.2 Pets with severe aggression or handling intolerance may only be accepted with the Owner present.\n4.3 Certain breeds (e.g., brachycephalic breeds) may be restricted from swimming unless certified fit by a veterinarian.\n
      \n

      5. Check-In, Check-Out & Timings<\/strong><\/h2>\n<\/div>\n5.1 Operational hours: 9:00 AM \u2013 9:00 PM\n5.2 Strict adherence to check-in\/check-out timings is required.\n5.3 Boarding is calculated on a 24-hour cycle with a 2-hour grace period.\n5.4 Delays beyond the grace period will incur additional daycare charges.\n
      \n

      6. Documentation Requirements<\/strong><\/h2>\n<\/div>\n6.1 Owners must provide:\n
        \n \t
      • Valid Government ID (PAN\/Aadhaar)<\/li>\n \t
      • Address proof<\/li>\n \t
      • Emergency contact (physically reachable individual)<\/li>\n<\/ul>\n6.2 All information provided must be accurate and complete.\n
        \n

        7. Payment Terms<\/strong><\/h2>\n<\/div>\n7.1 All services must be paid in full at check-in.\n7.2 Add-ons or extensions must be prepaid at the time of request.\n7.3 A non-refundable booking deposit may apply.\n7.4 No credit, cheque payments, or refunds unless explicitly stated.\n
        \n

        8. Feeding & Nutrition Policy<\/strong><\/h2>\n<\/div>\n8.1 Pets will be fed according to the in-house curated meal plan.\n8.2 Owners may provide special diets at their own risk.\n8.3 Boarding includes meals as per the nutritionist-approved diet chart.\n8.4 Additional meals\/snacks will be chargeable.\n
        \n

        9. Hygiene & Parasite Control<\/strong><\/h2>\n<\/div>\n9.1 Pets undergo hygiene checks at check-in, during their stay, and at check-out.\n9.2 Pets with ticks or fleas will receive mandatory treatment at the Owner\u2019s cost and may be isolated if required.\n9.3 The facility maintains strict sanitation and anti-parasitic protocols.\n9.4 Owners are strongly advised to maintain preventive treatments (e.g., Bravecto\/spot-on).\n
        \n

        10. Behaviour & Socialisation<\/strong><\/h2>\n<\/div>\n10.1 The facility operates leash-free open play zones; outside designated areas, pets must remain leashed.\n10.2 Minor injuries (scratches, bruises) may occur during social play.\n10.3 Pets with behavioral concerns may be isolated at management\u2019s discretion.\n10.4 Owners must disclose all behavioral history.\n10.5 Non-disclosure may result in termination of services without refund and may lead to legal action.\n
        \n

        11. Female Pets (Heat Cycle)<\/strong><\/h2>\n<\/div>\n11.1 Owners must disclose the last heat cycle date.\n11.2 Necessary supplies must be provided by the Owner.\n
        \n

        12. Medical Care & Emergency Authorization<\/strong><\/h2>\n<\/div>\n12.1 Basic first aid may be administered without prior notice if required.\n12.2 Owners will be informed immediately.\n12.3 If the Owner is unreachable, the Service Provider is authorized to seek veterinary care.\n12.4 All associated costs (including transport) shall be borne by the Owner.\n
        \n

        13. Liability & Risk Acknowledgment<\/strong><\/h2>\n<\/div>\n13.1 Pets are boarded entirely at the Owner\u2019s risk.\n13.2 The Service Provider shall not be liable for:\n
          \n \t
        • Injury, illness, or death due to natural, stress-related, or play-related causes<\/li>\n \t
        • Pre-existing conditions<\/li>\n \t
        • Incidents arising from group play, undisclosed conditions, or unpredictable behavior<\/li>\n<\/ul>\n13.3 The Owner is responsible for any damage or injury caused by their pet (excluding normal wear and tear).\n
          \n

          14. Limitation of Liability<\/strong><\/h2>\n<\/div>\nTo the maximum extent permitted by law, the Service Provider\u2019s total liability shall not exceed the total amount paid for the service.\n
          \n

          15. Indemnity<\/strong><\/h2>\n<\/div>\nThe Owner agrees to indemnify and hold harmless the Service Provider, its staff, and affiliates from any claims, damages, or liabilities arising from:\n
            \n \t
          • The pet\u2019s behavior<\/li>\n \t
          • Undisclosed medical or behavioral conditions<\/li>\n \t
          • Injury to third parties or damage to property<\/li>\n<\/ul>\n
            \n

            16. Abandonment Policy<\/strong><\/h2>\n<\/div>\n16.1 Pets not collected within 7 days without communication will be deemed abandoned.\n16.2 The Service Provider reserves the right to rehome the pet or hand it over to relevant authorities.\n
            \n

            17. Communication Policy<\/strong><\/h2>\n<\/div>\n17.1 Updates will be shared between 9:00 AM and 9:00 PM.\n17.2 No after-hours calls or WhatsApp support will be available.\n17.3 In case of emergencies, the Service Provider will proactively contact the Owner.\n
            \n

            18. Pet Belongings<\/strong><\/h2>\n<\/div>\n18.1 A maximum of 3 personal items (excluding essentials) is permitted.\n18.2 The Service Provider is not responsible for loss or damage to personal belongings.\n
            \n

            19. Grooming & Spa Services<\/strong><\/h2>\n<\/div>\n
              \n \t
            • No sedation will be used<\/li>\n \t
            • No harmful grooming practices (e.g., dyeing or shaving unless medically required)<\/li>\n \t
            • Severe matting may require trimming (with Owner consent)<\/li>\n \t
            • Additional charges apply for heavy infestations<\/li>\n \t
            • Certain breeds will not be shaved unless prescribed by a veterinarian<\/li>\n<\/ul>\n
              \n

              20. Swimming Services<\/strong><\/h2>\n<\/div>\n20.1 Session duration: 2 hours (includes 45\u201360 minutes swim time)\n20.2 Includes rinse and drying (not a full bath)\n20.3 No feeding at least 2 hours prior to the session\n20.4 Not suitable for all breeds; restrictions apply\n20.5 No refunds for unused session time\n20.6 Owners are responsible for assessing suitability\n
              \n

              21. Force Majeure<\/strong><\/h2>\n<\/div>\nThe Service Provider shall not be liable for any delay or failure due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, or pandemics.\n
              \n

              22. Cancellation & Refund Policy<\/strong><\/h2>\n<\/div>\n22.1 Deposits are non-refundable unless otherwise stated.\n22.2 No refunds for early check-out or last-minute cancellations.\n22.3 Any partial refunds are at the sole discretion of management.\n
              \n

              23. Media Consent<\/strong><\/h2>\n<\/div>\nThe Owner grants permission to the Service Provider to use photographs or videos of their pet for promotional or social media purposes unless explicitly declined in writing.\n
              \n

              24. Governing Law & Jurisdiction<\/strong><\/h2>\n<\/div>\nThis Agreement shall be governed by the laws of India.\nAll disputes shall be subject to the jurisdiction of courts in Bangalore, Karnataka.\n
              \n

              25. Acceptance of Terms<\/strong><\/h2>\n<\/div>\nBy availing services, the Owner confirms that:\n
                \n \t
              • All information provided is accurate<\/li>\n \t
              • They understand the risks of a social, kennel-free environment<\/li>\n \t
              • They agree to all terms stated in this Agreement<\/li>\n<\/ul>\n
                \n

                26. Privacy & Data Protection Clause<\/strong><\/h1>\n<\/div>\nWe take your privacy seriously.\n\n26.1 The Service Provider may collect and process personal data including:\n
                  \n \t
                • Owner details (name, phone number, ID proof, address)<\/li>\n \t
                • Pet information (medical history, vaccination records, behavior notes)<\/li>\n<\/ul>\n26.2 This data is used strictly for:\n
                    \n \t
                  • Service delivery and pet safety<\/li>\n \t
                  • Emergency communication<\/li>\n \t
                  • Legal and regulatory compliance<\/li>\n \t
                  • Internal record keeping<\/li>\n<\/ul>\n26.3 Data will\u00a0not be sold or shared with third parties<\/strong>, except:\n
                      \n \t
                    • Veterinary professionals (in case of medical need)<\/li>\n \t
                    • Government authorities (if legally required)<\/li>\n<\/ul>\n26.4 All reasonable measures are taken to protect data from unauthorized access, misuse, or loss.\n\n26.5 By using our services, the Owner\u00a0consents to the collection and use of data<\/strong>\u00a0as described.\n
                      \n

                      27. Assumption of Risk & Waiver Clause<\/strong><\/h1>\n<\/div>\n27.1 The Owner acknowledges that pet boarding, daycare, grooming, and social play environments involve\u00a0inherent risks<\/strong>, including but not limited to:\n
                        \n \t
                      • Minor injuries (scratches, bites, bruises)<\/li>\n \t
                      • Illness due to stress or environmental changes<\/li>\n \t
                      • Unpredictable interactions between animals<\/li>\n<\/ul>\n27.2 The Owner\u00a0voluntarily assumes all such risks<\/strong>\u00a0associated with participation in these services.\n\n27.3 The Owner hereby\u00a0waives, releases, and discharges<\/strong>\u00a0The Barkery and Brews, its owners, employees, and affiliates from any liability for:\n

                        • Injury, illness, or death of the pet<\/li>\n \t
                        • Loss or damage arising during the provision of services<\/li>\n<\/ul>\n27.4 This waiver applies\u00a0to the fullest extent permitted under Indian law<\/strong>.\n
                          \n

                          28. Digital Consent & Agreement Clause<\/strong><\/h1>\n<\/div>\n28.1 By proceeding with booking, check-in, or payment (online or offline), the Owner:\n
                            \n \t
                          • Confirms they have read and understood these Terms & Conditions<\/li>\n \t
                          • Agrees to be legally bound by them<\/li>\n \t
                          • Provides informed consent without coercion<\/li>\n<\/ul>\n28.2 Digital actions including:\n
                              \n \t
                            • Website checkbox acceptance<\/li>\n \t
                            • Online booking confirmation<\/li>\n \t
                            • WhatsApp\/email confirmations<\/li>\n \t
